Terms and conditions

 By confirming registration via email, or by signing and returning the registration form, to Swim Scene Ltd, you have agreed to the following terms and conditions. Please read carefully.

 

Privacy Policy

Under the General Data Protection Regulation (GDPR) (2018) your private data will NOT be shared with anyone other than the Swimming Teachers, Administrator and Accountant at Swim Scene Ltd. Your data will be solely used for the purpose of swimming lessons and invoicing at Swim Scene Ltd and will only be shared for as long as you are a customer. Any exceptions will be by explicit consent of the customer. Any emails or correspondence will be kept and used solely between Swim Scene staff.

 

Collection Notice

By entering into a paying contract with Swim Scene Ltd, you are giving your continued permission and consent for your personal data to be stored by Swim Scene Ltd and used for purposes of fulfilling the business activity in servicing your contract. You further consent to your personal data to be kept on Swim Scene Ltd files for 3 years after you leave. Relevant personal data is stored on our accounting system (Xero) as well as in password protected cloud storage (Dropbox). All paper copies and registers are either shredded or kept secure at the registered office. Any emails or correspondence will be kept and used solely between the staff at Swim Scene Ltd, unless by explicit consent of the Customer. .

 

News Bulletins

When registering a pupil for lessons you are agreeing for Swim Scene Ltd to stay in touch regarding news and important class updates. You can change your mind at any time by contacting us at admin@swimscene.co.uk. We will treat your information with respect, but it is the quickest way of notifying you of any changes and pool cancellations. If you decide to opt out of any future marketing, Newsletters or mailing lists then you will NOT receive any correspondence from Swim Scene including any cancellations or Pool closures.

 

Bookings
Swim Scene offers small class sizes over various times and days in the week, during school terms. We will do our best to accommodate clients’ wishes regarding specific lesson time slots, however we cannot guarantee your preferred time slot on any given day, as we have to match ability and class sizes across all slots.

If insufficient children are booked into your class, Swim Scene Ltd reserve the right to cancel the class for that course. In that instance you will be offered an alternative slot.

 

Fees & Payment

Fee is currently calculated on the lesson price of £15 per lesson for first child; £14 per lesson for second child; £13 per lesson for third child. Special prices are offered for squad training (45 minutes), as well as private and semi-private lessons.

Total annual lessons - 36/37/38 weeks of swimming lessons (depending on what day you book), over three terms, or six half terms.  

Billing per half term, or part thereof if customer joins after term start. Payment due on invoice presentation/receipt by email.

Cheques are no longer accepted due to Bank charges.

Clients to pay online via BACS, or using our Stripe payment platform which is secure.

 

Refunds, Cancellations & Catch-Ups
Fees paid are non-refundable and non-transferable.  

Swim Scene Ltd is not liable for any refund or rescheduling of lessons that are missed due to local adverse weather conditions. If the venue and roads are accessible and the teacher is there, lessons will take place as normal.

Swim Scene Ltd is not liable to refund any lessons cancelled due to circumstances such as sickness, or disease outbreaks.

In exceptional force majeure circumstances Swim Scene will pass a credit note for future lessons, once the Company has secured concessions from its suppliers.

Swim Scene Ltd or the Pool owners may on occasions have to cancel a class due to unforeseen problems. In this eventuality, we will either lay on an additional date, or offer you an alternative option.

Regret no catch-up lessons due to the lack of availability.

 

Medical conditions/Health records – Consent Policy

For health and safety reasons, please do not bring your child into the pool for 48 hours after suffering from diarrhoea. Or in the case of Cryptosporidium, then no swimming for 14 days after the symptoms have stopped.
If you are unsure of your child’s illness please seek doctors’ advice before returning to lessons.

Under the GDPR your consent is required when passing on medical information on the pupil registration form. It is your responsibility to notify Swim Scene Ltd of any changes in your child’s medical condition or learning disabilities, as soon as possible. This information will be only passed onto the teachers of Swim /Scene Ltd and not used in any other way. This information will be shown on the teachers registers on poolside.

All incident forms are completed at the time of incident and stored on file at the registered address under lock and key.

 

Photography and Video

No photography other than by our professional photographer is permitted at any time, in accordance with the Child protection Laws.

We will display upcoming photo shoots on our website at www.swimscene.co.uk. You will be given the option of opting out if you do NOT wish your child’s photo to be used on any of the Swim Scene Ltd platforms.

 

Baby Swimming

All babies and toddlers who are not potty trained need to wear a “Happy nappy”, which is a swim nappy and a Happy Nappy over the top. Please ensure that all nappies are taken away with you. Where possible change your baby on the floor to avoid accidents. Remember supervision is your responsibility not the Teachers.

For parent and baby lessons, there is to be only one adult in the pool at a time with each child, other family members may sit and watch.

 

Class Sizes

The class sizes are small at Swim Scene. The beginner classes are usually 4 pupils per teacher but once they are swimming lengths comfortably then this number increases to 6 or more pupils per teacher/coach. On occasions if the class numbers are too low you will be offered an alternative class at the discretion of Swim Scene Ltd. Rights are reserved to change this policy.

 

Health and Safety, Pool Etiquette issues

Some physical contact with your child is unavoidable and all staff adhere to the ASA(Swim England)/STA Child Protection guidelines. This will be dealt with in a professional and caring manner.

Please make sure that your child has eaten 1.5 hours before swimming.

Customers should aim to arrive no more than 15 minutes before the lesson and leave no more than 15 minutes after the lesson to reduce congestion and to help improve changing room comfort.

Please do not arrive late for your lesson as this can unsettle the other children.

Please ensure that you take your outdoor shoes and socks off as soon as you enter into the Changing rooms to avoid ingress of mud and dirt. Please store your shoes in the shelving or plastic boxes provided.

All those entering the pool agree to shower before entering the pool.

All children have to wear a hat for swimming (excluding Parent & Baby/Toddler classes) and shower before entering the pool.

No prams or car seats are to be taken onto the poolside or changing rooms.

Whilst on poolside please keep the noise to a minimum so that all lessons offer a peaceful atmosphere.

Please wait quietly for your lesson. Please do not enter the pool until the teacher says it is safe to do so and you must tell the teacher if leaving the pool before the end of the session.

Customers, not teachers, are responsible for their children at all times on poolside, in the changing rooms and on the pool premises.

No running please.

Customers are expected to behave in a civilised manner towards the teacher and other customers/pool owners and the use of foul language is not permitted at any time.

Glenda Davis, her teachers and the pool owners reserve the rights to ask anyone to leave the poolside at any time if they feel that the behaviour is unreasonable.

No food, glassware/crockery or sharp objects are allowed within the pool premises. Do not drink alcohol or chew gum.

All plasters and hair clips must be removed before swimming in case they cause damage to the pool filters.

Makeup/Cosmetics
No make-up or body lotions are to be used as these deteriorate pool water quality.

Smoking is strictly forbidden within any pool building or grounds.

Please ensure that you take all your rubbish home with you.

 

Valuables and Jewellery

Please leave all valuables and Jewellery at home or in your motor vehicle, Neither Swim Scene Ltd nor the pool owners can accept any responsibility for any loss or damage of any personal possessions. Personal belongings are left at the owner’s risk.

 

Teachers
If a teacher is unwell or cannot attend a session, a cover teacher shall be arranged. I will give as much advanced warning as I can in these situations. All the Teachers are fully ASA and STA qualified with their teacher rescue Award, CRB check and their own STA insurance.

 

Complaints procedure

We aim to provide a good customer service, however if you are not happy for any reason please speak to the teacher or assistant in the first instance or email/ring Glenda Davis to try and resolve the matter satisfactorily.
Be realistic about your child’s abilities and do not over-expect. This can cause much harm when children consistently fall short of their parents expectations.

 

Liability
Swim Scene Ltd does not accept responsibility for any personal injury or fatality, loss or damage to persons or property that may arise directly or indirectly from any child/children’s participation, or loss of property or articles left on the premises. The customer agrees not to seek to penalise, prosecute or claim compensation from Swim Scene Ltd or its Teachers and assistants for any injury, loss or damage.

 

Changes to Terms and Conditions

Swim Scene Ltd reserves the right to review and update the terms and conditions. You have the right to disagree to the amendments which must be in writing, within two weeks of receiving notice of the changes.

 

Emergency
In the event of an emergency, please clear the pool and wait instructions from the Teacher and pool owner. No attempt should be made to retrieve or recover your possessions from the changing rooms or anywhere else in the building. If necessary you will be evacuated and led to the correct meeting point.
